SUPREME COURT. – The case of the Sheriff of Henrico vs. Dr. A. E. Peticolas occupied the attention of this Court Saturday and yesterday. The case is an appeal from the decision of Judge Meredith, who released Dr. Peticolas from a commitment for contempt by the county Court. It will be recollected Dr. Peticolas, a witness in the Elmore and Daniel duel, refused to testify, and was committed for contempt. Mr. Aylett, counsel for Dr. P., moved the dismissal of the case on the ground that the Commonwealth in a criminal case was not entitled to a writ of error. This question having been argued Saturday and yesterday, by Messrs. Aylett and Marshall for Dr. P., and Mr. Young for the Commonwealth, the Court yesterday evening took the case, reserving their decision.
